Official Rules

Official Rules - 2006 Breeders' Cup Fantasy Challenge

The following promotion is intended for viewing in the United States (except Puerto Rico) and Canada (except Quebec) only and shall only be construed and evaluated according to applicable law.

ELIGIBILITY

To play you must be eighteen (18) years of age or older at date of registration and must have a valid email address and Internet access prior to November 1, 2006. No cost of registration. Residents of Puerto Rico and the Province of Quebec are not eligible. This game is open only to legal residents of all fifty (50) United States and the District of Columbia and all provinces of Canada with the exception of Quebec. Persons residing in any other jurisdictions may enter (unless this contest or entry into this contest is restricted or prohibited by applicable local law), but will not be eligible to win any prizes. All federal, state and local laws and regulations apply. Void where restricted or prohibited. Contest begins approximately two hours after the post position draw (scheduled for 11 a.m. Wed., Nov. 1, 2006) for the eight Breeders' Cup races have been completed, 2006 and ends when the Breeders' Cup Classic, the final race of the contest, run Saturday, November 4, is declared official by the stewards.

NO PURCHASE NECESSARY TO WIN OR PARTICIPATE. Buying will not help you win. Your chances of winning without making a purchase are the same as the chances of someone who purchases something. It is illegal to give any advantage to buyers in a sweepstakes.

Employees of Churchill Downs Incorporated, ESPN, ESPN Internet Ventures, the National Thoroughbred Racing Association ("NTRA"), Daily Racing Form Inc. and their respective affiliates, subsidiaries, contractors, directors, advertising agencies, horsemen, racing officials and their respective immediate family members or those living in the same household of such individuals are not eligible to win. All federal, state and local laws and regulations apply.

GENERAL CONDITIONS

This contest is governed by the applicable laws of the United States. All federal, state, provincial and local laws and regulations apply. By entering, participants agree to release, indemnify and hold harmless Churchill Downs Incorporated, ESPN, ESPN Internet Ventures, the National Thoroughbred Racing Association ("NTRA"), Daily Racing Form Inc. and their sponsors, respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize won.

CONDUCT

The Official Rules will be posted on the Breeders Cup Fantasy Challenge Web site, bcfc@churchilldowns.com, throughout the contest. By entering this contest, you agree to be bound by these official rules and the decisions of Arlington Park and their sponsors, which shall be final and binding in all respects.

The NTRA & Churchill Downs Inc. and its sponsors and partners reserve the right to, at their sole discretion, disqualify any individual that: tampers or attempts to tamper with the entry process or the operation of the contest or Web site; violates the "Official Rules;" or acts in any unsportsmanlike, rude, or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The NTRA & Churchill Downs Inc. reserve the right to terminate or modify this contest at any time. Note: We are allowing stable names this year and any use of intellectual property infringement, defamation, profanity or other objectionable language or names could result in disqualification in the sole discretion of NTRA & Churchill Downs Inc.

CAUTION -- Any attempt by an entrant or individual to deliberately damage any Web site or undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, The NTRA & Churchill Downs Inc. reserve the right to seek damages from any such person to the fullest extent permitted by law.

NOTIFICATION

Winners will be notified by e-mail, regular mail or telephone within seven (7) days after the date the winners are determined. Winners may be required to sign and return an affidavit of eligibility and acceptance of these "Official Rules" and a publicity/liability release (unless prohibited by law) within fifteen (15) days following attempted notification.

By accepting any prize, the winner (and, if applicable, companion) grant permission to the NTRA & Churchill Downs Inc. to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent.

In the event of a dispute about the identity of any entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be required to provide the NTRA & Churchill Downs Inc. with proof of identity, and proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. Prizes not confirmed and/or delivery accepted by November 30, 2006 may be forfeited or voided.

ENTRY

To enter the contest, go to bcfc@churchilldowns.com and complete the electronic registration form. All registrations must be received by post time for the first Breeders' Cup race, currently scheduled for 12:20 PM ET, November 4, 2006. No faxed, mailed, electronically mailed, or phoned-in entries are allowed; this is an Internet-based game only.

LIMIT

One entry per person, per e-mail address; the information you enter into the each of the fields of the electronic registration form must be unique. Duplicate entries are cause for disqualification of all involved entrants and stables, and are made at the sole discretion of the NTRA & Churchill Downs Inc..

The NTRA & Churchill Downs Inc., their sponsor(s) and partner(s) assume no responsibility for lost, late, misdirected, illegible or mutilated entries. The NTRA & Churchill Downs Inc. and their sponsor(s) and partner(s) are not responsible for lost, interrupted or unavailable hardware or software or telephone transmission or technical failures, garbled or jumbled transmission or other error of any kind, whether human, mechanical or electronic. Once submitted, entries and correspondence become the sole property of the NTRA & Churchill Downs Inc. and will not be returned.

WINNER SELECTION

This is a game of skill. Winners will be determined by the objective criteria set forth below. From all eligible entries received, the winners will be the players who accumulate the most points during the Breeders' Cup Fantasy Challenge contest according to these "Official Rules."

Odds of winning depend on the number of eligible registrations received and skill level of each entrant. In the event of a tie between two or more eligible entrants, the winner will be the person that most closely guesses the attendance at Churchill Downs on November 4, 2006, Breeders' Cup Day.

For a point of reference, the attendance for the past three Breeders' Cups run at Churchill Downs has been:

  • 2000: 76,043
  • 1998: 80,452
  • 1994: 71,671

    Winners will be determined before 12:00 p.m. ET, November 11, 2006. Winning entries must confirm residence and eligibility to receive prizes. Prizes will be shipped between November 18, 2006 and December 8, 2006. Any winners unconfirmed by this date forfeit their prizes.

    CONTEST CRITERIA

    Entrants' stables may consist of 16 horses, 3 jockeys and 5 trainers that are entered in the eight championship races that make up the Breeders' Cup. You may select your horses, jockeys and trainers from any of the eight races, but points will awarded only for the following finishers.

    This contest will use a rotisserie scoring system. Each stable will be awarded points on the following basis:

    Points for your selected horses are awarded for a top-three finish on the following basis:
    Points for your selected trainers and jockeys are awarded for a first place finish only on the following basis:

    Note: Any horse, jockey or trainer officially winning, placing or showing in the case of a dead heat will be given the place for which it tied for the purposes of determining a stable's score in this contest.

    The game will be scored approximately one hour after the running of the Breeders' Cup Classic, the final race of the contest.

    RACES

    The race schedule will consist of the eight races, as outlined above, that combine to make up the Breeders' Cup, all to be run on Saturday, November 4, 2006. Exact times and order of races to be determined at the post position draw on November 1, 2006.

    STABLE SELECTION TIMELINE

    Contestants will be able to select their stable in the following time period: From approximately two hours after the Breeders' Cup post position draw (scheduled for 11 a.m. ET, November 1, 2006), until post time for the first Breeders' Cup race, currently scheduled for approximately 12:22 PM ET, November 4, 2006, the first scoring race of the game. No entries will be allowed after this deadline.

    CHECKING STANDINGS

    Participants may check their standing online at bcfc.churchilldowns.com (access via user ID and password) at any time after successfully registering for the contest. Only the statistics in the races set forth above count toward a stable's score. Points can only be earned after successful enrollment in the game.
